1: Purpose and scope
These general conditions of sale (CGV) constitute the basis of commercial negotiations and are systematically sent or given to each buyer to enable them to place an order.
The general conditions of sale described below detail the rights and obligations of the company Originel mojo, micro-enterprise of Marie Camille Lefort and her client and, any adult individual wishing to make a purchase through the website https: // www.originelmojo.com/ exclusive property of Original mojo.
Any acceptance of the quote/purchase order including the clause “I acknowledge having read and accept the attached general conditions of sale” implies the buyer’s unreserved acceptance of these general conditions of sale.
2: Price
The prices of goods sold are those in effect on the day the order is taken. They are denominated in euros and calculated excluding taxes. Consequently, they will be increased by the transport costs applicable on the day of the order.
The company Originel Mojo grants itself the right to modify its prices at any time. However, it undertakes to invoice the goods ordered at the prices indicated when the order is registered.
3: Rebates and rebates
The proposed prices include discounts and rebates that the original mojo company would be required to grant taking into account its results or the payment by the buyer of certain services.
4: Discount
No discount will be granted in the event of early payment.
5: Payment terms
They depend on the delivery method chosen. Indeed, payment by credit card is obligatory except for hand delivery (cash payment possible)
Payments will be made under the following conditions: Immediate payment after validation in the online basket.
6: Reservation of title clause
The company Originel mojo retains ownership of the goods sold until full payment of the price, in principal and accessories. As such, if the buyer is subject to receivership or judicial liquidation, the company Originel mojo reserves the right to claim, within the framework of the collective procedure, the goods sold and remaining unpaid.
7: Force majeure
The liability of the company Originel mojo cannot be implemented if the non-execution or delay in the execution of one of its obligations described in these general conditions of sale results from a case of force majeure. As such, force majeure means any external, unpredictable and irresistible event within the meaning of article 1148 of the Civil Code.
8: Competent court
Any dispute relating to the use of the site https://www.originelmojo.com/ is subject to French law. Except in cases where the law does not permit it, exclusive jurisdiction is granted to the competent courts of Saint-Denis.
9: Delivery and shipping
The items offered for sale on https://www.originelmojo.com/ are deliverable to Reunion Island but also to mainland France.
They will be delivered to the delivery address that the customer has provided on the order form. Deliveries are made to the address indicated on the order form which can only be in the agreed geographical area. Orders are made by La Poste via COLISSIMO, delivery service with or without tracking, delivery with or without signature.
The company Originel mojo will provide the buyer with the tracking number of their package by e-mail. The buyer is delivered to his home by his postman. If the buyer is absent, he will receive a delivery notice from his postman, which allows him to collect the products ordered from the nearest post office, during a period indicated by the postal services. The risks associated with transport are the responsibility of the purchaser from the moment the items leave the premises of the Originel mojo company. The buyer is required to check, in the presence of the Post Office employee or the delivery person, the condition of the packaging of the goods and its contents upon delivery.
In the event of damage during transport, any protest must be made to the carrier within three days of delivery. In fact, the transport risk is borne entirely by the buyer.
In the event of missing or damaged goods during transport, the buyer must make all necessary reservations on the order form upon receipt of said goods. These reservations must also be confirmed in writing within three days following delivery, by email addressed to the company.
- Additional information on delivery times
- Delivery to Reunion : 7 working days on average from the date of the order.
- Delivery to mainland France : 15 working days on average from the date of the order.
The deadlines announced on the site are purely indicative and depend on the destination and availability of the product ordered. Exceeding this deadline cannot give rise to any cancellation of the order, to any reduction in the price paid by the buyer, or to any payment for damages.
Consequently, any reasonable delay (less than 30 days) in the delivery of the products cannot give rise to the benefit of the buyer:
- The award of damages;
- Cancellation of the order.
However, and in accordance with the provisions of article L.121–20–3 of the Consumer Code, failure to deliver after the expiration of a period of 30 days from the following day on which the customer placed his order, the customer will have the possibility to cancel his order without charge. The amounts he has paid will then be refunded to him.
In cases where it has the capacity, Originel mojo reserves the possibility of offering a product of quality and price equivalent to the initial product.
Originel mojo cannot be held responsible for additional delays caused by the non-issuance of a bank authorization or an incomplete order form.
In the event of partial delivery, transport costs will be invoiced only on the first delivery.
10. Shipping costs:
Customs or import taxes are not included in the delivery costs indicated and are the responsibility of the customer.
11.Right of withdrawal
In accordance with article L.121-21, the consumer has a withdrawal period of fourteen (14) calendar days to return their products.
In other words, the buyer has a period of 14 days to exercise his right of withdrawal from receipt of his order, the delivery notice from the Post Office being taken as proof.
Within 14 days following the date of receipt of the ordered goods, the buyer can therefore request an exchange or refund of the item(s) purchased.
Beyond the 14-day period, Originel mojo will be free to refuse the exchange or refund.
